 They confiscated Marina Oswald BEFORE Oswald was shot and killed. They did it on Saturday, when he was alive and well. 

How could they possibly expect to get away with that if he was going to live? You know how he reacted when he found out that the FBI went and talked with her. He blew up. He stormed into the FBI office in Dallas. Reportedly, he made threats. He left a note to James Hosty about it, which was destroyed; flushed down the toilet, its contents never revealed. 

Oswald was talking to his wife every day. He called her several times from the PD. How were they going to keep it from him that they took her? They couldn't. Imagine his reaction when he found out. He would have blown up. 

And there was a legal issue involved. They were charging him and prosecuting him for double homicide. A man is innocent until proven guilty. They had no legal right to confiscate his wife. She was not a suspect. She and Oswald were a legal unit; a team. Holding his wife in custody would have been automatic grounds of a Constitutional violation. And spousal privilege meant that they had no right to try to influence her or manipulate her in any way. They had the right to question her but not to detain her. 

And it was very stupid of them to do it. All they had to do was wait until Oswald was shot on Sunday. Then, his prosecution would have been over, and it would have been plausible that they were concerned about her safety after he was shot. But, to do it on Saturday before he was shot? 

So, let's analyze it. We know that Leavelle wore his Easter suit on Saturday. So, maybe they were going to do the Jail Transfer on Saturday. Then, it got pushed back to Sunday. Well, they should have postponed getting her. THEY TOOK POSSESSION OF OSWALD'S LIFE WHILE HE WAS STILL ALIVE. That would have been impossible to maintain. HOW COULD THEY PROSECUTE HIM WHILE HOLDING HIS WIFE? They couldn't. But, it wasn't a problem because they knew he was going to be dead. Stupid! They should have waited until Sunday, the dumb plucks. They knew Oswald was going to be dead because they were going to kill him.
