Those territories fell under the control and dominion of the United States government as much as any states did. The United States in 1838 consisted of the states and the territories. "United States" refers to a country. Its jurisdiction covers all the land in which the federal government of the United States has the force of law and a monopoly on use of police power, military power, etc. And that included the territories.
The Stupid Backass doesn't want to include Florida, even though it was involved in the Trail of Tears.
