Here’s my “take” on Oswald’s innocence:
- The American legal system principle of “presumption of innocence” (in the presence of particularly scanty evidence against him, and evidence of his history with American intelligence--so worrisome to the Warren Commission, that they immediately called for a closed Executive Session with the two Texas officials).
- Certainly that LHO was not on the sixth floor at the time of the shooting (witness statements re his having been on the first or second floors…and of the woman who insisted she'd seen no one descending down the back stairway at the time.
- Certainty that LHO was on the front steps of the TSBD at the time of shooting, based on identification of him in the famous Altgen photo (with long-sleeved, plaid, open-necked shirt…not the red vertically striped, short-sleeved one worn by Lovelady).
- Certainly that LHO was not on the sixth floor at the time of the shooting, based on careful examination of a very high resolution copy of the aforementioned Altgen photo (see below!)…showing JFK with his hands raised to neck level…just upon the turn onto Elm Street, before the view from the “sniper’s nest” would have been unobstructed by the maple tree. And that the throat shot would, of necessity, have been made from the front.
- Negative result of his cheek nitrate test...indicating no firing of a rifle during the prior couple of days. Plus his wife's initial testimony that she had never seen Lee with a rifle...and that no ammo was found in his or his wife's home.
- I will add that anyone using the junk WWII surplus weapon, with poorly mounted scope and difficult bolt action...supposedly the murder weapon...would have had to manually load each round...as no ammo clip was ever found, rendering the "three shots in 6.5 seconds" narrative impossible.
- Announcement of a description of Oswald as a suspect within thirty minutes of the shooting…as reported by Chief Curry, who said he had been so informed by an unidentified police officer, while he was at Parkland Hospital.
We have a SLAM-DUNK!! (AKA, CASE DISMISSED!!!)
